EMPLOYMENT LAW AND THE PARALEGAL

Advanced Employment Law presents a concise yet informative survey of the various laws governing the employment relationship. The thrust of this text is the impact of federal regulation on employment. Throughout the book, reference is made to the particular federal statute that applies in a given situation. In any instance where reference is not made to federal law, general legal principles are discussed. However, the law in each jurisdiction may vary on these points, and the reader should always refer to the state-specific law whenever the point in question is not federally regulated.

Each topic discussed in the text is deserving of a book of its own, and Advanced Employment Law is not intended to replace an in-depth analytical study of each of these fields. This textbook, however, will afford the reader a comprehensive overview of the most important facets of employment law.

Understanding employment law is a practical necessity for the paralegal, both professionally and personally. Professionally, the paralegal may be called upon to assist in the representation of an employee who is charging his or her employer with unlawful employment practices, or the paralegal may assist an employer who is defending a challenge to its employment policies. The paralegal may be asked to draft the initial version of an employment contract, an employee handbook, or an employment document for a human resources department.

On a personal level, a paralegal can be an employee, employer, or independent contractor. The paralegal should be conversant with the law that affects his or her working life. The following case illustrates the types of issues that will be highlighted throughout the text. These issues involve the laws that govern the employment relationship, the necessity for documenting employment practices, and the difficulty of proving employment claims.
