Law and Mental Disorder is a teaching text designed for law students, psychology graduate students, and medical students who are interested in the intersection between law and mental health. It brings together intellectual concerns related to the practice of psychiatry, psychology, and law, with the more traditional concerns about the care and treatment of mental patients. Detailed attention is given to a variety of topics including certification and licensing of mental health professionals, repressed memory and false memory, mental health testimony in court, and mandated reporting of child sexual abuse.
The book also examines assumptions made about the skills of mental health practitioners -- how well they actually perform their professional duties and how their expertise is received in courts of law as scientific evidence. Finally, Law and Mental Disorder explores the application of mental health law to civil law. In this context, attention is given to guardianship and conservatorship, and also to questions of responsibility under the law of contracts, torts, and property.
Law and Mental Disorder evolved from twenty-five years of teaching experience by authors Alexander and Scheflin, based on their extensive work in mental health law issues. Significant legal cases, extensive notes, and extracts from books and articles have been assembled to present the most currently important -- and the most controversial -- issues in forensic psychiatry in a lively and readable format.
